GRANTING A RIGHT TO LAY THE FOOTINGS OF A WALL ON THE NEIGHBOUR'S LAND





This Deed is made on this ________day of ___________between Sh.___________ s/o Sh. ________r/o _________ hereinafter called "the grantor" (which expression shall unless contrary to the context or meaning thereof include his successors, executors, administrators and assigns) and Sh.________ s/o Sh. ________r/o __________ hereinafter called "the grantee"(which expression shall unless contrary to the context or meaning thereof include his successors, executors, administrators and assigns).

Whereas

1. No. ________ in Municipal Registers and as delineated on the annexed plan and coloured blue (more specific description of the property may be given here or may be annexed as a Schedule).

2. The grantor being owner and in possession of plot of land situated at ___________ and as per entry No. ________ in Municipal Registers and as delineated on the annexed plan and coloured yellow (more specific description of the property may be given here or may be annexed as a Schedule).

3. The grantee intends to erect a boundary wall for protecting his plot of land, whose footings shall be laid on the Grantor’s land.

4. Per request grantee to the grantor and has consenting that the grantor, in consideration of the sum of Rs. ______, will grant to the grantee such rights as is mentioned hereinafter:

Now This Deed Witnesseth as Under:

That in consideration of a sum of Rs. _________ paid by the grantee to the grantor (which receipt is the acknowledged by the grantor), the grantor hereby grants to the grantee full rights and liberty to enter into and upon the said land of the grantor and to excavate the same to the width of ____feet and to a depth of ____feet along the boundary between the respective lands of the grantor and the grantee and to lay and forever hereafter to keep laid and maintained in such excavation at a depth of not less than_____ feet from the surface, all such footings /foundations of concrete, bricks, stone or other substance as the grantee shall think fit and just as the foundation or any part of the foundation of the said intended wall of the said house and also to erect scaffolding on the said land of the grantor for the purpose of erecting the said wall and to use such scaffolding during the erection of such wall for all usual building purpose and also to erect such scaffolding and use the same from time to time for repairing and painting the said work after giving two weeks' previous notice to the grantor.
